Terms of Service

1. Agreement Scope

These Terms of Service govern your access to and use of Vishiq, including the website, product dashboard, sandbox demo, APIs, and related support services.

By accessing or using Vishiq, you agree to these terms on behalf of yourself or the organization you represent. If you do not agree, do not use the service.

2. Eligibility and Authority

You must be legally capable of entering into a binding contract and must have authority to bind any organization account you create or administer.

You are responsible for ensuring users in your workspace follow these terms and applicable laws.

3. Accounts and Security

You must provide accurate account information and keep it up to date.

You are responsible for maintaining the confidentiality of login credentials and for all activity under your account.

You must promptly notify us at support@attendflow.app if you suspect unauthorized access.

4. Acceptable Use

You may not misuse Vishiq, including attempting unauthorized access, bypassing security, reverse engineering restricted components, distributing malware, or interfering with service availability.

You may not use the service to violate law, infringe rights, or submit unlawful, deceptive, or abusive content.

5. Subscriptions, Billing, and Taxes

Paid plans are billed per active seat or according to your order terms. Pricing and feature limits are shown at checkout or in an executed order form.

Unless otherwise stated, subscriptions renew automatically at the end of each billing cycle.

You authorize recurring charges for your selected plan until canceled. You are responsible for applicable taxes, duties, or government fees.

6. Trials, Cancellations, and Refunds

Free trials and promotional credits may be limited by time, features, or eligibility.

You can cancel renewal before the next billing date to avoid future charges. Access to paid features may continue until the current period ends.

Refunds, if any, are handled according to the checkout terms, order form, or explicit written policy in effect at purchase time.

7. Intellectual Property

Vishiq and all related software, designs, trademarks, and documentation are owned by us or our licensors and protected by intellectual property laws.

Subject to these terms, we grant you a limited, non-exclusive, non-transferable right to use the service during your subscription term.

No ownership rights are transferred to you.

8. Customer Data and Licenses

You retain ownership of Customer Data you submit to the service.

You grant us a limited license to host, process, transmit, and display Customer Data solely to provide, secure, support, and improve the service.

You represent that you have all rights and permissions needed for Customer Data submitted to Vishiq.

9. Confidentiality

Each party may receive non-public information from the other. The receiving party must protect that information with reasonable care and use it only for permitted purposes.

Confidentiality obligations do not apply to information that is publicly available, independently developed, or lawfully received without restriction.

10. Third-Party Services

Vishiq may integrate with third-party tools and infrastructure providers. Your use of third-party services may be subject to separate terms from those providers.

We are not responsible for third-party services we do not control.

11. Suspension and Termination

We may suspend or limit access if necessary to prevent harm, investigate abuse, comply with law, or enforce these terms.

Either party may terminate according to subscription terms. Upon termination, your access may end and data handling will follow the applicable retention policy and legal obligations.

12. Disclaimers

Vishiq is provided on an as-is and as-available basis except as explicitly stated in a signed agreement.

To the maximum extent permitted by law, we disclaim implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

13. Limitation of Liability

To the extent permitted by law, neither party is liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, or data.

Our aggregate liability for claims arising out of or related to the service is limited to the amount paid by you for Vishiq during the 12 months preceding the event giving rise to liability.

These limitations apply regardless of legal theory and even if a remedy fails of its essential purpose.

14. Indemnification

You will indemnify and hold us harmless from claims, damages, liabilities, and expenses arising from your misuse of the service, violation of these terms, or violation of applicable law or third-party rights.

15. Governing Law and Disputes

These terms are governed by applicable law identified in your order form or, if none is specified, the law of our principal place of business, excluding conflict-of-law rules.

Parties will attempt good-faith resolution before formal proceedings. Venue and jurisdiction are the competent courts under the governing law framework.

16. Changes to These Terms

We may update these terms to reflect legal, security, product, or operational changes.

If changes are material, we will post an updated version with a new effective date and may provide additional notice where required.

Continued use after the effective date constitutes acceptance of the updated terms.
